More regulation is the wrong way to tackle the recession

They may not agree on much,but the EU governments managed to agree this weekend that more regulation of financial markets is needed. This focus on regulation has now become the default position,along with the more populist campaign against bankers’ bonuses, of governments which do not know what to do to fix the recession.

There is a paradox in the current recession, but it is not the often quoted one about ‘the paradox of thrift’. The true paradox is that governments are calling for more regulation and less risk,when it should be the other way round. The avoidance of risk, along with the desire to make more money, was behind the rapid growth of hedge funds. By spreading the risk of investments across the world economy the intention was to avoid over exposure to any one group of investments. These hedge funds attracted wealth on a grand scale.

Meanwhile, the latest figures on venture capital in the UK show that relatively tiny amounts of money have been put into innovative new businesses. The culture of risk avoidance, which is endemic in the UK and not limited to the economy, is a far greater threat to the future of the economy than under regulated markets.

British Pound Tumbles 200 Points to 1.80 as UK's Darling Sounds the Recession Alarm

The British pound started out on a weak note at the start of trading on Sunday, as the currency plunged 200 points versus the greenback following the release of comments by UK Chancellor of the Exchequer Alistair Darling from an interview with the Guardian newspaper.
During the interview, Mr. Darling said that the UK economic conditions “are arguably the worst they've been in 60 years” and that the slowdown may be “more profound and long-lasting than people thought.” Looking at the latest economic data, there’s little reason to doubt Mr. Darling’s dour sentiment. The August reading of the purchasing managers’ index (PMI) for the manufacturing sector reflected a contraction in business activity for the fourth consecutive month, though the index did rise slightly to 45.9 from 44.1.

Meanwhile, the Bank of England’s reading of mortgage approvals fell to 33,000 in July, marking the lowest level since record-keeping began in 1999. Overall, there are literally no bright spots on the horizon for the UK economy, but nevertheless, the Bank of England is widely expected to leave rates unchanged at 5.00 percent on Thursday. However, it is also widely known that the central bank has sought to maintain a hawkish stance against inflation in an effort to keep the public’s expectations in check. Thus, a rate cut may not be on hand this week, but with Credit Suisse overnight index swaps pricing in over 75bps worth of cuts within the next 12 months, it’s simply a matter of time before the Bank Rate comes down.

UK recession unlike any other, says Gordon Brown

Gordon Brown said today that the recession now gripping Britain was unlike any others since the Great Depression, caused not by domestic economic mismanagement but by a "complete market failure" set off by the sub-prime crisis in the United States.

As statisticians confirmed the UK's first recession since 1991 and the largest quarterly contraction in 28 years, Mr Brown - who spent ten years as Chancellor under Tony Blair before taking over as Prime Minister - said co-ordinated international action would be the key to lifing the global economy quickly out of the downturn.
And he insisted that he and his Chancellor, Alistair Darling, had had no choice but to commit billions of pounds of public money to shoring up the banking system because the "cost of inaction" would have been much greater.
"Every recession in the last 60 years in Britain has been caused by inflation, domestically generated, caused by wages getting out of control on some occasions, by interest rates having to rise," Mr Brown told BBC Radio 4's Today programme.
"This is a completely different type of event, as everyone recognises. This results from a global banking crisis. So America's already in recession. Germany's been in recession for some time. The euro area is in recession. It's a global financial crisis caused by irresponsible lending practices."
Mr Brown was speaking shortly before the Office of National Statistics announced that Britain's gross domestic product (GDP) had contracted by 1.5 per cent in the final quarter of 2008, a significantly higher contraction than economists had expected only a few weeks ago. That was the worst figure for a single quarter since 1980, during Margaret Thatcher's first term in office, when Britain's manufacturing sector was devastated, and presaged a similarly disastrous rise in unemployment.

The figure drove sterling to a 23-year low against the dollar under $1.36.
“Coming out of America in the next few weeks will be a major, major stimulus package that will help the rest of the world. Other countries in Europe are about to make decisions themselves about the future and I think that is very, very important as well,” Mr Brown said.“If for example China could create more domestic expansion itself, then the world would be going in harmony, going in tandem, to deal with ... what is a synchronised banking failure.”
Mr Brown declined to detail the level of taxpayers' exposure to the financial crisis through the multibillion pound schemes to bail out the banking sector, despite a call from the Treasury Select Committee for the Government to come clean. "Just think of the cost of doing nothing," he said. "No saver lost any money even though banks were in danger of collapsing all over the place in Britain. We stopped the banks from collapse."
David Cameron, the Tory leader Mr Cameron, warned yesterday that Britain could soon have to go to the International Monetary Fund for cash, repeating the action of James Callaghan’s Labour Government in 1976, because of the parlous state of public finances. But Mr Brown dismissed his comments as “ridiculous behaviour”, adding: "The situation in Britain is this: that we have low public debt, we have low inflation, wages are under control.”
He also lashed out at prominent investors such as hedge fund boss Jim Rogers, who have been giving dire assessments of the prospects for UK plc and sterling. “If you think we are going to build our policy around the comments of a few speculators who want to make money out of Britain then you are very, very wrong indeed,” he said. “The decisions we take about the future of the economy are based on what is right for Britain.”

Asked to identify the mistakes he made as Chancellor, Mr Brown said that economic policy had been focused on inflation. "We believed, rightly so, that we could get inflation down in this country and with low interest rates and a low inflation economy it could continue to grow.
"We also believed that there was a possibility of institutional failure in the banking and financial system so we did all sorts of exercises, simulation exercises. We had the FSA put in place - I think people recognise it's one of the best regulators, not one of the worst - but what we didn't see, nobody saw, was the possibility of complete market failure, that markets seized up across the world."

Gordon Brown refuses to apologize over recession despite plea by Alistair Darling

The Prime Minister has rejected pleas from Cabinet colleagues and will not use a speech in Washington on Wednesday to issue any sort of apology for the role he played while Chancellor in allowing banks and the City to operate unfettered.

In a candid interview in the Telegraph, Alistair Darling said that the Government and regulators had “lots of lessons” to learn from the events that led to the economic crash.
The Chancellor’s frank admission that there is a need for ministers to show “humility” will have irritated the Prime Minister as it is in stark contrast to his own view of the crisis. And it exposes a potentially damaging rift between Mr Brown and his Chancellor.
Mr Darling’s handling of the Treasury brief in recent months has been called into question. Last week he had to admit he did not know about the scale of Sir Fred Goodwin’s £693,000 a year pension deal which had been waved through by one of his junior ministers.
Mr Brown is meeting Barack Obama in Washington to discuss the global economic recovery plan that the Prime Minister hopes to kick start when he hosts next month’s world leaders G20 gathering in London.
But the trip threatened to be overshadowed by the row over whether Mr Brown should apologise and show some contrition. It is known that some Cabinet colleagues have been privately urging him to make an apology of sorts.

However, the Prime Minister has rejected outright the need to make any sort of admission.
In direct contrast to his Chancellor, he defiantly believes that the problems were unique and were not the fault of the system he put in place and presided over while at the Treasury for a decade.
John Kingman, the head of UK Financial Investments and a former close ally of Mr Brown at the Treasury, has added to the pressure on Mr Brown by admitting that the tri-partite system of City regulation had not worked.
He told the Treasury Select Committee in London: “There are issues around how the Treasury and the regulator identified problems.”
When asked whether he was reluctant to admit that the system that Labour put in place in 1997 had been a massive failure, he replied: “I don’t think I am massively reluctant.”
Mr Brown has defended his actions as Chancellor and argues that the current recession is not typical of previous downturns caused by high inflation and rising interest rates. Instead it is a banking crisis that has been caused by poor decisions by bankers such as when RBS took over the Dutch bank ABN Amro in 2007 and took on board a slew of poor sub-prime debt.
The Prime Minister also knows that if he admits he made mistakes he will hand a massive propaganda coup to the Conservatives.

But Mr Darling told the Telegraph: “There are a lot of lessons to be learnt by regulators, governments, all of us. The key thing that went wrong was that a culture was allowed to develop over the last 15 years or so where the relationship between what people did and what they got went way out of alignment, especially at the top end.
”If there is a fault, it is our collective responsibility. All of us have to have the humility to accept that over the last few years, things got out of alignment.”
He added: "There are some very hard questions to be asked about the regulatory model we have operated for the last few years.
”The model of us saying to them [the banks] ‘you say it’s OK to us and we’ll go along with it’ has failed. You should regulate according to risk... financial services have to be properly run and supervised.”
As well as today’s White House meeting, Mr Brown has also been invited to address a joint session of Congress on Wednesday - only the fifth British premier to make such a speech.
He is on a mission to deliver a “clear message” to Mr Obama from Europe about the need for urgent worldwide action to counter the economic crisis.
Mr Brown believes that, working together, the UK and US can persuade other leading economies to sign up to a co-ordinated programme of action at next month’s G20 summit in London that can restore confidence among consumers, companies and banks worldwide.
In a change to the anticipated schedule of events for today, the White House indicated that Mr Obama would not hold a full press conference with Mr Brown, but the two leaders would instead appear in front of the media in the Oval Office.
Prime Minister Gordon Brown today called for concerted international action to improve the regulation of the global financial industry as he prepared for his first meeting with Barack Obama since he became US President.

Speaking to National Public Radio in Washington, Mr Brown said it was time to “clean up the banking system” and create international standards on banking transparency, accountability and pay.
Shared rules would allow the international community to freeze out jurisdictions which do not live up to the standards and deal with so-called “shadow banks”, he said. And Global co-operation on restructuring the banking system would create the confidence to allow recovery from the economic downturn.
Mr Brown will later today become the first European leader to hold talks at the White House with Mr Obama since his inauguration in January.
The international economic crisis will be top of the agenda for the talks, with Mr Brown hoping to secure a clear signal that the President is ready to back an international economic rescue package when the G20 group of major economies meet in London on April 2.
Plans for a formal press conference following the talks have been downgraded by the White House to a brief appearance before the cameras by the two men inside the Oval Office.
Mr Brown will on Wednesday issue a plea for America to resist protectionism as he addresses both houses of Congress.

Ahead of the meeting, he spelt out his message in his interview with National Public Radio’s Morning Edition - the most listened-to radio news programme in the US - in which he predicted that recovery from the economic downturn could come “with some speed” if nations around the world are prepared to work together to restore confidence in the banking system.
Mr Brown declined to say when he thought the economy would return to growth.
But he said: “This is a global problem. It needs global solutions. There is a global banking collapse that we are dealing with.
”If we could have the same standards and the same rules that we are about to apply in the USA and in Britain to apply to other countries around the world, the same standards of disclosure and accountability and remuneration, I think the confidence in the banking system will be restored.”

Tyco International Surges After Profit Tops Estimates

- Tyco International Ltd. rose the most in more than six years in New York trading after the world’s largest maker of security systems posted first-quarter profit and sales that exceeded analysts’ estimates.
Tyco International climbed $3.93, or 19 percent, to $24.27 at 4:15 p.m. in New York Stock Exchange composite trading, the biggest percentage increase since July 26, 2002. The shares are up 12 percent so far this year.
Sales excluding acquisitions, divestitures and currency effects fell 1 percent, beating the company’s November forecast of as much as a 3 percent decline. Restructuring and other expenses declined from a year earlier. Tyco raised its estimate for cost-cutting charges this year to as much as $150 million from $50 million as it shrinks to cope with the slowing economy.
Better-than-expected results “were driven by substantially better operating margins,” Nigel Coe, an analyst at Deutsche Bank, wrote in a note to clients. “With growth in the recurring revenue and modest backlog build, this result will likely be viewed in a favorable light.” He has a “buy” rating on Tyco.
Profit from continuing operations declined 24 percent to $272 million, or 57 cents a share, from $360 million, or 72 cents, a year earlier, the Bermuda-based company said today in a statement. Revenue in the quarter ended Dec. 26 fell 8.5 percent to $4.43 billion.
Excluding some items, Tyco International earned 61 cents a share. The average of 12 analysts’ estimates compiled by Bloomberg was for 47 cents on sales of $4.39 billion. Results fell in each of Tyco’s five main divisions, hurt by the strengthening U.S. dollar and weak demand in North America and Europe.

2009 Forecast
For the year ending in September, per-share profit will be $2.28 to $2.50 a share, excluding potential restructuring costs of 8 cents a share, Tyco International said. That’s in line with the previous November forecast that included such costs and was $2.20 to $2.50.
Tyco International decided to exclude the restructuring costs because they aren’t yet set and to make the forecast “as neat and clean as possible,” Chief Executive Officer Ed Breen said on a conference call. As economic conditions become more clear, Tyco will update the forecast on cost cutting, he said. The unchanged $2.50-a-share end of the range reflects a reduced outlook for the electrical and metal unit.
“While the environment is clearly more challenging, I believe we have the appropriate focus and disciplines to address our cost structure and our long-term growth initiatives,” Breen said on the call.
Swiss Move
In the second quarter, total revenue will be $4.2 billion to $4.3 billion, while per-share profit should be 40 cents to 43 cents, excluding about 6 cents in restructuring costs and other expenses, Breen said. Currency translation will shave about $500 million, Breen said.
The electrical and metal products segment will likely have a better second half of year than first as costs improve, Breen said.
“We see Tyco as one of only a few names within industrials that we would buy both relative and absolute,” Scott Davis, a Morgan Stanley analyst, wrote in a note to investors today, citing results and the 2009 forecast. He has an “overweight” rating on the stock.
Tyco International, run from West Windsor, New Jersey, projected on Nov. 11 that first quarter profit from continuing operations excluding some items would be 46 cents to 49 cents a share.

The company said it December it is seeking to move its headquarters to Switzerland, which has an established tax treaty with the U.S.

Tyco International agreed to sell most of its infrastructure business known as Earth Tech to Aecom Technology Corp. for $510 million in the 2008 second quarter. The company agreed to sell its Ancon building products unit for $174 million in cash in the third quarter.
The company also said today that Admiral Dennis C. Blair has resigned from the board after President Barack Obama appointed him as director of national intelligence.

Market Share J.C. Penney Bridge Plan Targets Market Share Gains in Downturn

The J.C. Penney bridge plan, initiated in early 2008 to help it mitigate the impact of a slowing economy, has helped the retailer survive the recession and position itself for market share gains.
In discussing 2008 results during a Friday conference call that included lower but a better than expected earnings, the company reported that it cut headquarters and store labor expenses, managing to realign its work functions without the major lay offs many of its competitors have initiated.

In one example, it saved $16 million in selling-related labor costs in December even as it improved customer service scores by more effectively pegging employee hours to peak selling periods. Because it launched its plan at the beginning of 2008, J.C. Penney got a jump on costs before the economic downturn deepened later in the year, so it was in a position not only to cut labor expenses in the critical holiday selling season but also to slash inventories by 10.5%.
And, although it dropped its store opening pace from 50 annually, J.C. Penny did manage to opened 35 new or relocated stores in 2008 while committing $970 million to capital spending, down from $1.2 billion in 2007 and a little below the reduced number of $1 billion it announced under the bridge plan. The company plans to spend about $600 million this year opening 17 new stores, including its first Manhattan location, and renovating existing ones. J.C. Penney is opening new stores in a period when many rivals are closing locations, a point chairman and CEO Mike Ulman made in the call.

Store closings and some outright liquidations, of the Mervyns chain particularly, provide J.C. Penney a ready chance to win market share. So do service disruptions and problems with keeping shelves properly stocked that will arise at other stores as management deals with work force issues in the midst of major layoffs.

Why "Anheuser-Busch" Hall?

The Current is happy to join with the whole University community in celebrating the Anheuser-Busch Foundation's recent gift of $2.5 million, to underwrite, in part, construction of a new building for the College of Business Administration. While we hope that we may avoid a charge of biting the hand that feeds us, we are nonetheless perturbed to learn that the new building will be christened Anheuser-Busch Hall.
We are constrained to wonder why the new facility will not be called "Anheuser-Busch InBev Hall." That, after all, is the new name of the corporate entity that has contributed, for over 150 years, to the worldwide reputation of St. Louis as the home of what is, arguably, the world's best (certainly the best-selling) beer.
Is the soft-pedaling of the InBev takeover a tacit admission of the bad taste that the beer wars have left in the mouths of St. Louisans? We cannot help but wonder why A-B InBev, and its corporate dependent, the A-B Foundation, have been so studious in ignoring the InBev connection in terms of the Foundation's corporate largesse.
All of this is beside the point. What has caught us off-guard is the fact that the building is to be named for the sponsoring corporation at all. There is subtext to this decision, and we are not pleased thereby.

We understand that the University of Missouri - St. Louis, being a public institution, lacks, to a great degree, the cachet that private institutions of higher education, with their private endowments, enjoy. We appreciate that UM-St. Louis is, in many ways, the red-headed stepchild of public education in Missouri.
We get the fact that, without the charity of a private enterprise, the College of Business Administration's construction effort would be just that much further from realizing its financing goal. We do not feel that the point had to be rammed home quite so bluntly, or so blatantly, by naming the new facility Anheuser-Busch Hall.
If A-B and the College of Business Administration wanted to draw the connection between business education and the business of beer, we submit that a better name might have been "August Anheuser Hall," or "Adolphus Busch Hall," or even "August Anheuser/Adolphus Busch Hall." Any of those choices would have paid tribute to the business leaders who built the brewery that built St. Louis' reputation. Naming the facility "Augustus A. Busch, III Hall," would have at least afforded the opportunity to nickname the building, "The Gussie," the same way the Blanche M. Touhill Performing Arts Center is affectionately known as "The Blanche."
We note that the North Campus quadrangle is bounded, on the south, by Thomas Jefferson Library, and on the east by Clark Hall, named for William Clark; on the northeast stands Lucas Hall, named for St. Louis pioneer Jean-Baptiste-Marie Lucas.
We submit, that if A-B and the College of Business Administration wanted to honor the business heritage of St. Louis, they would have done better to name the new building "Chouteau Hall," which would honor the greatest of St. Louis' entrepreneurial pioneers. That, at least, would have maintained the historical integrity of the system by which UM-St. Louis named its academic buildings.
As it stands, we have to wonder whether A-B's gift actually constitutes a charitable contribution, or an advertising expense.

China Sees Global Law-Firm Growth as Jobs Fall in U.S., U.K.

Yuval Tal’s new office in Hong Kong, New York-based Proskauer Rose LLP’s first in Asia, doesn’t have a doorbell yet, and he’s already planning to open another in Beijing “as soon as we can.”

London’s Slaughter and May will also open in China’s capital once it gets the needed approvals, adding to the 28 foreign firms in mainland China since September 2006, a 19 percent increase to 177 firms. In Hong Kong, they’ve doubled to 66 since 2004, driven by initial public offerings that raised more than $40 billion a year in 2006 and 2007.
The continued expansion comes as some of the largest U.S. and U.K. law firms cut jobs at home because of the global financial crisis. While China isn’t immune -- new share sales collapsed to $7.9 billion last year -- lawyers said the country’s growing importance to clients makes it an essential location for global law firms, along with New York and London.
“It’s insane not to be doubling down on China if you can afford to take the long-term view,” said Christopher Stephens, Asia managing partner of Orrick, Herrington & Sutcliffe LLP.
With the world’s largest foreign-currency reserves and third-largest economy “it’s now at the center of resolving global economic, financial and political crises,” Stephens said. San-Francisco based Orrick cut 40 structured-finance, real estate and corporate lawyers worldwide in November.
Latham & Watkins LLP, based in Los Angeles, expanded its Hong Kong office this month into a local law practice with the addition of seven lawyers from Allen & Overy LLP, including the U.K. firm’s former Asia corporate chief, Michael Liu.

Shift to Asia
“Latham & Watkins made a significant investment in London and Europe in the last decade, and you’re now seeing that same approach in Asia,” said Joseph Bevash, its Hong Kong managing partner. “A preponderance of future deals” will involve U.S., U.K. or Hong Kong law, he said.
The Hong Kong law capacity that Skadden, Arps, Slate, Meagher & Flom LLP developed in 2005 helped the New York-based firm win work from Coca-Cola Co. advising on its planned $2.3 billion acquisition of China Huiyuan Juice Group Ltd.
“Skadden has a long relationship with Coca-Cola in the U.S., and we were able to demonstrate that we had the right platform and experience in Hong Kong and China to advise them on this deal,” said Nicholas Norris, co-head of the firm’s Hong Kong practice.
The purchase of China’s largest fruit juice maker, listed in Hong Kong, will be Coca-Cola’s largest outside the U.S. if approved by regulators.

Chinalco, Minmetals
Chinese companies seeking acquisitions like Aluminum Corp. of China (Chinalco) and China Minmetals Corp. are also encouraging firms like Slaughter and May to open in Beijing, according to Hong Kong Senior Partner Richard Thornhill.
“Last year everybody saw an increase in Chinese outbound acquisitions, and we concluded that we needed to be there physically,” he said. The world’s top metal user, China has agreed to acquire $22 billion worth of commodity assets this year. Chinese companies are also considering buying businesses like Ford Motor Co.’s Volvo car unit.
“This is potentially the buying opportunity of a lifetime,” said Howard Chao, Asia practice chairman of Los Angeles-based O’Melveny & Myers LLP. “Besides energy and resources, general manufacturing like automobiles, this is a great opportunity for Chinese companies to build a global network.”
Asia’s long-term growth prospects lie behind Chicago-based Winston & Strawn LLP’s opening a Hong Kong office in December, according to Asian Practice Chairman Simon Luk.

Right Time
The current financial crisis may affect its plans for Beijing and Shanghai offices, he added. “Clearly we’re looking at the environment and the time to decide.”
New private equity investments in Asia fell 38 percent to $54.9 billion last year, while the funds raised by private equity-invested companies from new share sales slumped 77 percent to $15.2 billion, according to the Asian Venture Capital Journal.
“The market has become smaller, and private equity activity is down,” said Neil Torpey, Hong Kong office chairman of Los Angeles-based Paul, Hastings, Janofsky & Walker LLP. “Many bank- affiliated investment groups are either closing up shop or not doing much.”
The impact on China from the global financial crisis is just starting to be felt, according to Peter Charlton, Asia managing partner for Clifford Chance LLP, the London-based firm advising Chinalco on its $19.5 billion acquisition of Rio Tinto Group debt and stakes in its mines.

Cutbacks, Caution
“Chinese and other Asian businesses will continue to invest in the region and beyond, but many clients outside the region are cutting back on investment into China at the moment,” Charlton said.
“When I came here in November, I wanted to double Asian revenues and had hoped that was achievable in a four-year time frame. It’ll take longer, and we’ll be more cautious about growth,” he said in a Jan. 21 interview.
Clifford Chance, the world’s largest law firm by revenue, said Feb. 4 it would cut as many as 106 lawyers in the U.S. and U.K. Firms including Allen & Overy have also been trimming their staff in Hong Kong and China.
Proskauer Rose said some clients, including the National Basketball Association, are going ahead with plans in China and opening a Beijing office is important to serving more than U.S. clients. Proskauer fired 35 lawyers and about 25 support administrative staff in December.
“Obviously it’s a difficult market to expand in, and we’ll be prudent, but this is a long-term plan for us,” Tal said this month in an interview.

Boston Properties Inc., the biggest US office landlord by market value, said fourth-quarter earnings fell as the company wrote down the value of investments in joint ventures.
Funds from operations, a cash flow measure used by real estate investment trusts, fell to $5.9 million, or 5 cents a share, from $147.5 million, or $1.22, a year ago, the company said in a statement distributed today by Business Wire. Boston Properties had a net loss of $91.6 million, or 76 cents, compared with profit of $123.8 million, or $1.02, a year ago.

Chairman Mortimer Zuckerman, 71, said yesterday in an interview that the recession and credit crisis will make for “a much tougher 2009 than many people are expecting.”
“Almost all tenants have moved to the sidelines,” he said. They’re afraid to make a commitment, because they’ve lost confidence in the future of the economy.”
Funds from operations is net income excluding depreciation and certain one-time items, including property dispositions, and doesn’t conform with generally accepted accounting principles.
Boston Properties rose $3.44, or 7.8 percent, to close at $47.29 in New York Stock Exchange composite trading. The shares have declined 14 percent this year, compared with a 14 percent drop in the 14-member Bloomberg REIT Office Property Index.

Potash Sale

Rio Tinto Ltd, the world's third biggest miner, has completed the $US850 million ($A1.32 billion) sale of its undeveloped potash assets in Argentina and Canada to Brazilian group Vale.
The global miner is attempting to reduce its debt and conserve cash by cutting capital spending, shedding about 14,000 jobs and increasing asset sales.

The potash divestment was part of a larger transaction with Vale that includes the sale of the Corumba iron ore mine in Brazil and an associated logistics operations in Paraguay.
Rio Tinto said the $US750 million ($A1.17 billion) Corumba sale is expected in the second half of 2009 when appropriate consents are received.

Anglo American has set up teams to study the iron ore assets of Rio Tinto and BHP Billiton should the mining giants be told to divest operations as a requirement of allowing the latter's hostile takeover to progress.
Anglo is understood to be keen on picking up iron ore projects in Australia - seen by many as the most likely assets to be sold if regulators force disposals on BHP.
The company has significant iron ore projects in Brazil and plans to boost capital expenditure on its assets to take advantage of soaring prices that have seen Chinese steel makers recently agree to almost double the price they pay suppliers such as Rio Tinto and Brazil's Vale.

However, buying assets in Australia would give the group a far stronger position.
Xstrata, which recently ceased takeover talks with Vale, is also studying Rio and BHP assets in the region.
The European Commission is due to announce within the next few weeks whether it will block the BHP takeover, clear it, or take its investigation to a more detailed phase. Most in the industry, including BHP itself, believe the latter outcome to be the most likely.
John Meyer, an analyst with investment bank Fairfax, said: "I think it will be a very big issue with the EU. I would be extremely surprised if there wasn't a divestment required. At the end of the day, the EU is not going to want to see so much Australian iron ore concentrated in single hands."

Rio Tinto, which is listed in the UK and Australia, currently employs 97,000 people worldwide.
It said it was responding to "the unprecedented rapidity and severity of the global economic downturn".
In the past few months, Rio Tinto has been fending off a takeover approach from rival BHP Billiton, which finally abandoned its offer in November.

Price moves
Rio Tinto said that closing one of its London offices would not necessarily lead to job cuts. Less than 2% of its workforce are based in the UK.
It said that the job cuts would comprise 8,500 contractors and 5,500 employees.
As a global miner, Rio Tinto is very sensitive to commodities prices and exchange rates.
It benefited from soaring metals prices in the first half of the year, but has since suffered as they have fallen back.
But falling oil prices have been good news for it - a $1-a-barrel fall in the price of oil adds about $11m to the group's earnings.
Debt problems
Rio Tinto's shares ended Wednesday trading up 256 pence to just above £15, although they are still well off the year's high above £70 a share.
Analysts say the level of its debt has been one of the factors depressing the company's value.

A vast country with immense economic resources, the Democratic Republic of Congo (DR Congo) has been at the centre of what could be termed Africa's world war.
This has left it in the grip of a humanitarian crisis.
The five-year conflict pitted government forces, supported by Angola, Namibia and Zimbabwe, against rebels backed by Uganda and Rwanda. Despite a peace deal and the formation of a transitional government in 2003, the threat of civil war has re-emerged in the east of the country.

The war claimed an estimated three million lives, either as a direct result of fighting or because of disease and malnutrition. It has been called possibly the worst emergency to unfold in Africa in recent decades.
The war had an economic as well as a political side. Fighting was fuelled by the country's vast mineral wealth, with all sides taking advantage of the anarchy to plunder natural resources.
The history of DR Congo has been one of civil war and corruption. After independence in 1960, the country immediately faced an army mutiny and an attempt at secession by its mineral-rich province of Katanga.
A year later, its prime minister, Patrice Lumumba, was seized and killed by troops loyal to army chief Joseph Mobutu.
In 1965 Mobutu seized power, later renaming the country Zaire and himself Mobutu Sese Seko. He turned Zaire into a springboard for operations against Soviet-backed Angola and thereby ensured US backing. But he also made Zaire synonymous with corruption.

Nonetheless, DR Congo's troubles continued. A rift between Mr Kabila and his former allies sparked a new rebellion, backed by Rwanda and Uganda. Angola, Namibia and Zimbabwe took Kabila's side, turning the country into a vast battleground.
Coup attempts and sporadic violence heralded renewed fighting in the eastern part of the country in 2008. Rwandan Hutu militias clashed with government forces in April, displacing thousands of civilians.
Another militia under rebel General Laurent Nkunda had signed a peace deal with the government in January, but clashes broke out again in August. Gen Nkunda's forces advanced on government bases and the provincial capital Goma in the autumn, causing civilians and troops to flee while UN peacekeepers tried to hold the line alongside the remaining government forces.
In an attempt to bring the situation under control, the government in January 2009 invited in troops from Rwanda to help mount a joint operation against the Rwandan rebel Hutu militias active in eastern DR Congo.
Rwanda also moved to arrest the Hutu militias' main rival, Gen Nkunda, a Congolese Tutsi hitherto seen as its main ally in the area.
However, the lot of DR Congo's citizens is little improved. The Crisis Group, a Brussels-based think-tank, said in 2005 that 1,000 people were dying every day from war-related causes, including disease, hunger and violence.

European US stock Financial Stocks Pull Down European Markets

Markets in Asia and Europe fell on Monday, after a report showed that Japan’s economy contracted in the last quarter at its quickest pace in 35 years and a weekend meeting of the Group of 7 finance ministers provided few concrete proposals to counter the recession.
Screens in China showed markets in Europe and Asia lower on Monday. U.S. markets were closed on Washington’s Birthday.
Drops in Europe came after losses in Asia, but trading volumes were subdued as American markets were closed for Washington’s Birthday. American markets reopen Tuesday.

The FTSE 100 in London declined 1.31 percent, the DAX in Frankfurt sank 1.06 percent, and the CAC 40 in Paris dropped 1.19 percent.
Japan’s worse-than-expected fourth-quarter G.D.P. numbers were a sobering reminder of the toll the worst economic downturn in decades is having on Asia’s export-driven economies. Its economy, the world’s second-biggest, shrank 3.3 percent from the previous quarter, or at an annual pace of 12.7 percent.
In Europe, financial stocks dragged markets lower. Shares in Lloyds Banking were volatile in London after the company’s revelation Friday of larger-than-expected losses at the recently acquired Bank of Scotland and on market fears that the combined company might be headed for nationalization.
Shares dropped 20 percent in early trading, but regained ground to close down 8.1 percent. Shares had dropped 30 percent on Friday.
Insurance companies also dragged down the London exchange. The Legal and General Group fell 10.5 percent, Prudential lost 8 percent and Aviva slipped 7 percent.
“Whereas before people were just selling banks, now they are looking at the risk involved with other financials,” said Jane Coffey, head of equities at Royal London Asset Management.
Investors seemed disappointed after finance chiefs from the Group of 7 developed countries finished their meeting in Rome with pledges to work together to bolster growth and unemployment, but stopped short of concrete measures.
Increasingly, investors are unconvinced that world governments are acting quickly enough to counter the economic crisis, analysts said.
“The global recession is deeper than anticipated. At the same time, policy makers are failing to deliver measures to address the problems,” said Dariusz Kowalczyk, chief investment strategist for SJS Markets in Hong Kong. “It seems that what they’re doing is too little too late.”
The Nikkei 225 stock average in Japan edged down 0.38 percent, to 7,750.17 on Monday, and the Hang Seng index in Hong Kong dropped 0.73 percent, to 13,455.88.

The Kospi in South Korea lost 1.4 percent.
India’s benchmark tumbled 3.6 percent after the government, proposing its interim budget, offered no new stimulus measures. Markets in Australia and Singapore also retreated.
In Japan, several exporters were hurt by the data showing the economy sank deeper into recession.
The result represents the steepest drop for Japan since the oil shock of 1974 and outpaced G.D.P. drops in the United States and the euro zone.

A survey of economists by Kyodo news agency had projected an 11.6 percent annualized contraction.
“It’s clearly very shocking data,” said Clive McDonnell, head of Asia strategy at BNP Paribas Securities in Hong Kong. “The drop is certainly beyond our own quite negative expectations.”
Shares in the Toyota Motor Corporation lost 0.7 percent, while the electronics heavyweight Canon slid 1.2 percent and the Sony Corporation fell 1.3 percent.
In the United States, equity markets were closed for Washington’s Birthday. On Friday, the Dow Jones industrial average fell 1 percent, to 7,850.41, its lowest close since Nov. 20. The Standard & Poor’s 500-stock fell 1 percent, ending its week off 4.8 percent.

Insurance Journal reports that Zurich Financial Services Group, an insurance focused financial services provider, has reached an agreement with Women’s World Banking (WWB), a New York based network of microfinance providers and banks, to establish strategic collaboration in the area of microinsurance. Under the arrangement, a global program will be created to pilot and roll out “caregiver” products, insurance-based solutions providing predefined benefits to clients of WWB affiliate institutions during hospitalization events. The target demographic is primarily female caregivers in low-income households. MicroInsurance Center LLC, a consultancy and research group focused on developing sustainable insurance programs, will aid in designing the endeavor. No further information regarding the specifics of the agreement is released.
WWB President and CEO Ms. Mary Ellen Iskenderian noted that the program with Zurich holds great promise in addressing poverty, especially for females. “Women, more often than not, are the family’s primary caregiver in impoverished areas,” said Ms. Iskenderian. “During a health event, there are more than just medical expenses - lost wages, child care, and transportation to and from the hospital - all add pressure on a household during a tough time. The caregiver program is designed to address just these issues.” The program may also have a multiplier effect in terms of entrepreneurship in low-income populations. That is, saving for adverse events, rather than investing in businesses, often puts the poor at a further disadvantage in their economic mobility efforts. Therefore, insurance programs which lower the need for savings by pooling risk could potentially unlock entrepreneurial outlays by low-income women.

Likewise, the insurance giant believes that, “collaboration with WWB marks another major milestone on Zurich’s route to address the significant unmet need for insurance among disadvantaged populations, especially in emerging markets,” according to Brandon Mathews, Head of Microinsurance. He added, “WWB’s 30 year history of microfinance innovation and its deep customer knowledge perfectly combine with Zurich’s risk management expertise.”

The latest capital raising exercise by Sumitomo Mitsui Financial Group (SMFG) shows that Japanese banks are weak, although for different reasons than their Western counterparts who have been hurt by their exposure to the subprime crisis. Japanese banks are suffering from a slowing economy, narrow interest margins and excessive exposure to the stockmarket. So, like Western banks, they are busy raising capital.
The ¥538.2 billion ($5.84 billion) worth of perpetual preference shares SMFG plans to issue through a private placement on December 18 should take some of the pressure off the company's capital adequacy ratios, which have become increasingly thin. An unconfirmed rumour that SMFG, the smallest of Japan's mega-banks by assets, could add an extra ¥260 billion to the sum already announced gave the market further reason to cheer, and helped push SMFG's share price 9.6% higher to ¥342,000 in Thursday's trading. (The counter reached a high of ¥1.36 million in 2006.)

According to Reuters, the preference shares will be taken up by a collection of around 20 Japanese institutional investors, including real estate and insurance companies.
SMFG's announcement on Thursday follows a decision made public on November 19 to set up a wholly owned overseas special purpose subsidiary in the Cayman Islands to issue perpetual preference shares. The proceeds will partly be used to redeem an existing series of bonds maturing on January 26, 2009, which amounts to ¥283 billion. The remaining ¥255 billion will be added to the existing tier-1 capital of ¥4.5 trillion, an increase of under 6%. That means the extra capital raising if it materialises will be welcome, since it could roughly double the percentage increase.
The structure for issuing the non-cumulative preference shares is complex but has advantages. Under the terms of the deal, the offshore group vehicle will issue the shares, and then make what is essentially an intra-company loan with the proceeds. This combines tax benefits with a boost to the tier-1 capital cushion, points out Peter Kilner, managing partner at Clifford Chance in Tokyo.

"One of the reasons for the structure is that interest paid on the loan should be deductible by Sumitomo Mitsuin Banking Corporation (SMBC) for tax purposes, which would not be the case if SMBC were to pay dividends on the preference shares direct," he explains.
SMBC is the actual bank and the main asset within the SMFG group.
The preference shares will be issued in four tranches of ¥113 billion, ¥140 billion, ¥140 billion, ¥145.2 billion, with coupons of 4.57%, 5.07%, 4.87% and 4.76% respectively. The tranches all come with fixed rates until various dates, including 2014, 2016 or 2019, before switching to a floating rate. One of the tranches comes with a step-up clause.
Even prior to the announcement earlier this month that Japan has entered a recession, SMFG was being hit by the steeply declining stockmarket. The TOPIX index has dropped by almost one-third since March this year. Reductions in unrealised stock gains initially hurt tier-2 capital, but once the gains turn to losses, essential tier-1 capital also begins to get eaten away. The decline in Japan's stockmarket over the past months has been so fast that it has raised the alarm about Japanese banks.

Observers say the fact that Japanese banks as a group own some 15% of the listed Japanese market cap is a sign that the banking sector is not yet 'normalised'. The ownership is down substantially from its peak, but still leaves the banks vulnerable to swings in the equity market. The shareholdings are part of the elaborate cross-shareholding arrangement that originally arose to protect Japanese companies from hostile often defined as 'foreign' takeovers.
Fitch Ratings writes in a recent report that SMFG's unrealised gains on stocks had fallen from ¥936 billion in March to ¥786 billion in September, while losses on bonds amounted to ¥60 billion. The cost of these figures to tier-1 capital amounted to almost half of tier-1 equity.

Swiss Re Gets $2.6 Billion From Berkshire Hathaway

Swiss Re, based in Zurich, said it would receive 3 billion Swiss francs, or about $2.6 billion, from Berkshire Hathaway, Mr. Buffett’s holding company, and would consider raising another 2 billion francs in equity if the market would bear it. The company also reported a 2008 net loss of about 1 billion francs.
Mr. Buffett has moved opportunistically since the onset of the financial crisis, wrapping up deals to invest $5 billion in Goldman Sachs and $3 billion in General Electric, receiving lucrative terms in both cases.
In a statement on Thursday, Mr. Buffett said he was “delighted” with the Swiss Re deal, and was “very impressed” by the company chief executive, Jacques Aigrain, and his management team.
Berkshire already has significant business ties with Swiss Re. In January 2008, it entered a quota share arrangement with Swiss Re through which it acquired 20 percent of its new and renewed property and casualty business in exchange and acquired 3 percent of its shares at the same time.

Berkshire “is a very strong source of capital and liquidity and there are not many of those around right now,” said Mark Nicholson, an analyst at Standard & Poor’s Equity Research in London.
Swiss Re’s capital was depleted by losses of 6 billion francs on its financial market operations, including mark-to-market losses of 2 billion francs for its holdings of structured credit-default swaps. The Swiss company made its announcement as Deutsche Bank, the largest German bank, posted a fourth-quarter loss of 4.8 billion euros, or $6.2 billion, compared with a profit of 1 billion euros a year earlier. It also reported a loss of 3.9 billion euros for 2008. The results were in line with forecasts made by the bank in January.
“Looking forward, we see continuing very difficult conditions for the global economy,” Josef Ackermann, the Deutsche Bank chairman, said in a statement. Later, though, he said in Frankfurt that he was hopeful about 2009. “With all the appropriate caution, this gives us confidence for 2009,” Bloomberg News quoted Mr. Ackermann as saying. “We are certain Deutsche Bank will emerge from this crisis stronger.”

Banco Santander, the largest Spanish lender, said 2008 had been a complex year and warned that 2009 would be challenging. It said its nonperforming loans more than doubled in 2008, to 14.2 billion euros from 6.2 billion euros a year earlier, suggesting more pain was ahead.
Last week, Santander said 2008 net profit fell 2 percent from a year earlier, to 8.9 billion euros. The bank was required by regulators to report its 2008 results ahead of schedule because of concern about the extent to which it would be hurt by its clients’ exposure to funds run by Bernard L. Madoff, the financier who investigators say has acknowledged running a $50 billion Ponzi scheme. Santander has offered compensation of 1.38 billion euros in shares to those clients.

If your primary investing objective is to preserve your capital while generating a tax-free income stream, municipal bonds are worth considering. Municipal bonds, or munis, are debt obligations issued by government entities. When you buy a municipal bond, you are loaning money to the issuer in exchange for a set number of interest payments over a predetermined period. At the end of that period, the bond reaches its maturity date, and the full amount of your original investment is returned to you.

While municipal bonds are available in both taxable and tax-exempt formats, the tax-exempt bonds tend to get the most attention because the income they generate is for most investors exempt from federal and, in many cases, state and local income taxes. Investors subject to the alternative minimum tax must include interest income from certain munis when calculating the tax, and should consult a tax professional prior to investing

Two Varieties
Municipal bonds come in two varieties: general obligation bonds and revenue bonds. General obligation bonds, issued to raise immediate capital to cover expenses, are supported by the taxing power of the issuer. Revenue bonds, which are issued to fund infrastructure projects, are supported by the income generated by those projects. Both types of bonds are tax exempt and particularly attractive to risk-averse investors due to the high likelihood that the issuers will repay their debts.

Risk Factors
While buying municipals bonds is most often viewed as a conservative investment strategy, it is not risk-free. Hare are the risk factors:

Credit Risk If the issuer is unable to meets its financial obligations, it may fail to make scheduled interest payments and/or be unable to repay the principal upon maturity. Interest-Rate Risk The interest rate of most municipal bonds is paid at a fixed rate. The rate does not change over the life of the bond. If interest rates in the marketplace rise, the bond you own will be paying a lower yield relative to the yield offered by newly issued bonds.

Tax-Bracket Changes Because municipal bonds generate tax-free income, they generally pay lower interest rates than taxable bonds. Investors who anticipate a significant drop in their marginal income-tax rate may be better served by the higher yield available from taxable bonds.
Call Risk Many bonds allow the issuer to repay all or a portion of the bond prior to the maturity date. The investor's capital is returned with a premium added in exchange for the early debt retirement. While you get your entire initial investment plus some back if the bond is called, your income stream ends earlier than you were expecting it to.

Market Risk The underlying price of a particular bond changes in response to market conditions. When interest rates fall, newly issued bonds will pay a lower yield than existing issues, which makes the older bonds more attractive. Investors who want the higher yield may be willing to pay a premium to get it. Likewise, if interest rates rise, newly issued bonds will pay a higher yield than existing issues. The issuer of a municipal bond receives a cash payment at the time of issuance in exchange for a promise to repay the investors who provide the cash payment (the bond holder) over time. Repayment periods can be as short as a few months (although this is rare) to 20, 30, or 40 years, or even longer.

The issuer typically uses proceeds from a bond sale to pay for capital projects or for other purposes it cannot or does not desire to pay for immediately with funds on hand. Tax regulations governing municipal bonds generally require all money raised by a bond sale to be spent on one-time capital projects within three to five years of issuance.[1] Certain exceptions permit the issuance of bonds to fund other items, including ongoing operations and maintenance expenses, the purchase of single-family and multi-family mortgages, and the funding of student loans, among many other things.

OPEC Delays 35 Oil Projects to Boost Prices

The declining oil prices, owing to the financial crisis which erodes world demand for crude oil, has forced the Organisation of Petroleum Expor-ting Countries (OPEC) to delay 35 oil projects till after 2013.
OPEC's Secretary-General, Mr. Abdalla El-Badri, disclosed at a Chatham House energy conference, weekend that the group's revenue had been adversely affected by oil's record plunge, a development which he said prompted member countries to set back 35 of the 150 projects due to come on stream in the next few years to expand supply.
El-Badri had in a report published in OPEC website stated that the falling prices of crude oil will not only affect investments in both the upstream and downstream sector, but would delay future investments. He raised fears that if the present situation does not change, it will lead to cancellation of future investments and automatically affect oil supply to the market.

"If the present situation does not change and we do not return to reasonable prices for oil products, the likely effects will be far-reaching. Very low prices will affect investments in both the upstream and downstream. This will have two main consequences. First, it will delay future investments in the sector, and second, it may also lead to the cancellation of further future investments. "Either way, this will automatically affect oil supply to the market. In addition, it will also have an effect on gas supply," he said.

OPEC which pumps a third of the world's oil earned close to $1-trillion last year, according to the U. S. Energy Information Administration.
But El-Badri confirmed that the group's income this year would be cut by 50 per cent. "The decline ‘cost’ OPEC US$356-billion in income in the period from the peak in prices to last month,” he said, adding that the startup dates of many other projects are still expected to slip.

The OPEC scribe said declining oil demand worldwide had prompted OPEC to reduce output by 4.2 million barrels per day (bpd) since September to prop up prices, boosting its unused production capacity to about eight million bpd.
Despite the gloom, OPEC has attempted to stay ahead of the slowdown in demand, by removing 4.2 million bpd of production from the market, about five per cent of daily world demand.
El-Badri said early indications are that members have delivered on 80 per cent of that pact, higher than some estimates. Another 900,000 bpd had to go to ensure perfect compliance, he added.
Oil has fallen to $40 a barrel from a record high of $147 in July 2008 as a deepening recession erodes demand for fuel. To help revive prices, OPEC said it is willing to cut yet more oil output at a meeting in March.

Oil prices fall on rising U.S. stockpiles

COLUMBUS, Ohio – Oil prices rose in volatile trading today after the U.S. government reported enormous buildups of oil and gasoline at U.S. storage depots, another manifestation of how badly the deteriorating economy has cut into energy demand.
Including the latest report from the Department of Energy, crude inventory levels have risen by 14 million barrels since the week ended Jan. 2, pushing operational capacity at key storage sites to the limit.
Prices tumbled seven per cent before a late day rally, with light, sweet crude for March delivery settling up 12 cents at US$43.67 on the New York Mercantile Exchange.
Crude fell early in the day after the Commerce Department reported that new-home construction plunged to an all-time low in December. There was also more evidence that export-driven economies in Asia are being hit hard by the recession. Oil inventory data pushed prices even lower before oil prices and the stock market rallied.

Even with the jump in crude supplies, prices at the pump edged up again overnight as refiners cut back production in reaction to falling demand.
The Energy Department's Energy Information Administration said for the week ended Friday crude inventories rose by 6.1 million barrels, or 1.9 per cent, to 332.7 million barrels.
Analysts had expected a boost of only 1.9 million barrels, according to a survey by Platts, the energy information arm of McGraw-Hill Cos.

The same report showed how much less Americans are driving as the recession reaches across almost every economic sector in the country.
Gasoline inventories rose by 6.5 million barrels, or three per cent, to 220 million barrels, more than three times what was expected by analysts.
U.S. refineries have begun shutting operations for regular maintenance, and are also trying to match rapidly falling demand ran at 83.3 per cent of total capacity on average, a drop of 1.9 per cent from the prior week and also more drastic than what was expected.

That sent gasoline futures tumbling close to 10 per cent at one point today.
Many consumers have been frustrated by the disparity between crude prices, which has been on the decline, and retail gasoline prices, which have been rising for weeks.
The EIA report confirms that stocks continue to build as demand falls.

Crude oil futures decline on weak global trend

Crude oil fell by 2.72 per cent in futures trading today on traders selling influenced by a weakening trend in the international markets.
On the Multi Commodity Exchange, crude for delivery in June fell 2.72 per cent to Rs 2,543 a barrel in a trading volume of five lots.

The May and February contracts fell by 2.36 per cent each to Rs 2,442 and Rs 1,864 a barrel, respectively. The May contract attracted 17 lots, while February recorded a business volume of 6,924 lots.
Meanwhile, in the overseas market, crude oil dropped to $37.55 a barrel as deepening recession reduced demand for the fuel.

Why did three Republican senators give their crucial support to the stimulus bill finally agreed by Congress last night?

The details certainly looked important. The House of Representatives' version of the stimulus bill cost $819bn and contained more money for state budgets and school reconstruction. The Senate version weighed in at $838bn and contained more tax credits and cuts. And the final version, approved on Wednesday evening by negotiators from both legislative bodies, is $789bn, with an added dab of this and a subtracted touch of that.
How did the House and Senate sort out this fine-tuned legislative machinery? The proximate answer, as always, is the triumph of representative democracy and the legislative process. But the ultimate answer is that Arlen Specter, Olympia Snowe and Susan Collins – the three moderate Republican Senators whose support was required to shuttle the stimulus through the Senate – wanted it that way. Why did they want it that why? I'm not sure. As far as I can tell, neither are they.

The final negotiation was a victory of nice-sounding statesmanlike process – "moderation," "centrism," "bipartisanship," "spirit of compromise" – over actual legislative substance. Earlier this week Specter wrote an op-ed in the Washington Post that explained his support for the stimulus bill (his version). His argument for why the bill should be whittled down to under $800bn was essentially: (1) An important life lesson is that you should listen to other points of view; (2) $780bn is less than $940bn; (3) $780bn is greater than $0; (4) if you don't agree with me you'll get $0; and (5) an important life lesson is that you can't always get what you want. And so the Democrats did not get billions of dollars of what they wanted.

But missing from the Specter argument, and from the final negotiation process, was a sense that some points of view are better than others, and that some policy prescriptions will do more to stimulate the economy than others. Here's my favourite example: Senate Republicans wanted a higher proportion of tax cuts in the final version of the bill than was in the House version. That's a point of view, and it even has a theory behind it: while standard Keynesian theory suggests that a dollar of spending is more effective stimulus than a dollar of tax cuts (since the latter is likely to be saved and not spent) there is genuine disagreement over whether this holds in practice. And lots of people agree that carefully targeted tax cuts – reductions in payroll tax withholdings, which overwhelmingly affect middle- and lower middle-class earners – can stimulate consumption.

But instead of having that debate, the Senate took the legislatively lazy route: it added a $70bn patch on the Alternative Minimum Tax. This was strange for many reasons. The AMT patch is not targeted: 80% of the benefits go to the top 20% of wage earners. Nor is it timely: the patch would pass later this year as part of the regular appropriations process, just as it has in years past. And it's not even a great legislative bargaining chip: Chuck Grassley, the Republican senator who stuffed the AMT provision into the bill like a suitcase before a vacation, ended up voting against the stimulus.

So why was it kept? Because it gives the zealous moderates the appearance of winning the process. It looks like Democrats accommodated Republican requests to ratchet up the tax cuts. It looks like Republicans get more tax cuts. And it more than looks like Specter and Collins and Snowe can claim they brokered an "important compromise" during a "difficult time." Also, they helped the middle class. All while doing nothing to stimulate the economy and sucking up dollars that could be put to better use elsewhere.
Specter, Collin and Snowe took a political approach to a policy question – they wanted the symbolism and efficacy of compromise, not the effectiveness of good policy. I would have preferred to see them put their time and our money to use elsewhere. But you can't always get what you want.
